Wayfair Tax Announcement

Attention Valued Supplier:

 

As a professional courtesy, we wish to bring to your attention a recent change made to the State of South Dakota Retail Sales and Service Tax statute (“Sales Tax”).  Governor Kristi Noem signed Senate Bill 30 into law on February 9, 2023.

South Dakota received a favorable decision from the U.S. Supreme Court and has led the charge to further the idea of economic nexus in the world of sales tax.  (South Dakota v. Wayfair, Inc., 585 U.S. 2018)  This Wayfair-related legislation eliminated one of two tests for determining when a remote seller is required to remit sales tax to the South Dakota Department of Revenue on sales of goods or services into the state.  The “200 or more separate transaction” test has been eliminated by SB30.  The “exceeds one hundred thousand dollars” threshold is now the sole test.

We suggest discussing the impact of the legislation, if any, on your business with your tax advisor.

Relevant Contacts

Be sure to add all of your relevant Contacts to the system. When you register as a new Supplier or Bidder, your Contact information is added to the system. However, if you are a New User for an Existing Supplier, or your Supplier Admin added you as a New Supplier Portal User, your Contact information was not requested. You will need to add it manually by navigating to the Secure Supplier Portal Homepage, clicking the Manage Profile Tile, clicking the Contacts menu item, and then adding your Contact information.

 

Note that a Contact Phone Number is required so that you can receive SMS Text Notifications or a Phone Call for Multi-Factor Authentication prior to logging into the Black Hills Supplier Portal.

When associating an attachment with a Supplier Registration, Bidder Registration, Supplier Change Request, or a Bid Response, please note the following supported document types:

New User for an Existing Supplier Instructions

Once you have registered as a New User for an Existing Supplier, it is strongly recommended that you log into the Supplier Portal and perform a Supplier Change Request. This will allow you to review the way your Supplier record is curently set up in the Black Hills ERP system, and request any corrections or changes to bring it up-to-date.

Please note:  In accordance with Black Hills Energy policy, passwords must be changed every 60 days, contain a minimum of 14 characters, and passwords must contain at least three out of the four following requirements: Upper case letter, lower case letter, number or special character (“&” for example).
